The following Terms of Sale will apply to the purchase of any products sold by aussiebest through the Website (‘ Products '). In placing your order by clicking on the ‘MAKE PAYMENT' icon in the online ordering facility you acknowledge that you have read, understood and agree to be bound by these Terms of Sale . If you do not agree and do not wish to place an order, please return to our home page.
1. Placement of Website Orders
1.1 Completion & Processing of Orders
Your online order has been completed once you have proceeded through the secure payment system on the Website and clicked on the ‘MAKE PAYMENT' icon. Once your order has been processed, you will receive an automatic e-mail confirmation of the order. A hard copy tax invoice in respect of your purchase will also be sent to you when your order is delivered.
While aussiebest will use all reasonable endeavours to ensure that the online ordering facility on the Website will be available, accurate and error free, aussiebest will not be responsible or liable in any way for any interruption or discontinuance of any or all of the functionality of the Website, including, without limitation, the online ordering facility.
1.2 Wholesale & Retail Bulk Orders
Please note that aussiebest currently only accepts orders through the online ordering facility on the Website from customers who wish to purchase Products for personal, non-commercial use. If you wish to enquire about placing a bulk order for the purpose of wholesaling or commercial retailing of the Products, please contact aussiebest direct.
2. Availability of Products
aussiebest appreciates your interest in its Products and will endeavour to make the Products available for purchase from the Website at all times. From time to time, however, heavy demand, limited editions or other factors beyond the control of aussiebest may render the Products temporarily or permanently unavailable. We will endeavour to notify you if this will affect your order in any way.
aussiebest may in its absolute discretion decline to supply the Products where (a) the Products are unavailable for any reason; (b) an order placed through the Website has not been received by aussiebest for any reason; or (c) full payment for the Products has not been received by aussiebest from you at the time of ordering the Products.
Please note that as some of our Products are handmade from individual raw materials, including timber and leather, slight variations may occur in the appearance and colour. The colour of Products displayed online may also vary slightly depending upon the individual user's monitor and display settings.
3. Prices, Tax & Duties
Prices for the Products are the amounts specified in Australian dollars on the Website as at the date of purchase (‘ Prices ') and are inclusive of postage and handling charges. We reserve the right to alter the Prices on the Website without notice. Australian users are liable to pay GST in addition to the Prices.
The Prices do not include insurance nor customs duties, taxes or other inbound government charges or fees levied at the point of entry in countries outside Australia. Additional costs for optional insurance to delivery addresses outside Australia are as indicated in the online ordering facility. You may request insurance at the time of ordering your Products, with the additional cost to be borne by you. Customs duties, taxes and inbound government charges are also your responsibility and must be paid by you at the time of delivery of the Products.
4. Payment Terms
Full payment is required at the time of placing your order through the Website. After entering your order, contact details and delivery address, you will be required to enter details of your preferred method of payment. Payments for online purchases through the Website are currently accepted by all major credit cards. You may also elect to download and print our payment form and fax or post the form to aussiebest with your credit card details, bank cheque or money order.
5. Delivery
5.1 Estimated Delivery Times
aussiebest uses Australia Post, Monday through Friday (excluding public holidays) to service our local and international postal needs. Orders to delivery addresses within Australia are despatched via registered post or express post. We will endeavour to post your order within five (5) days of your order being received, subject to availability and time of ordering. You will receive an e-mail notifying you of the date of despatch of your order from aussiebest's premises.
Normal delivery time is 10-14 days from the date of ordering to locations in Australia, New Zealand, Canada, the USA and the UK. aussiebest will endeavour to deliver in accordance with these estimated time frames, however as aussiebest is reliant on Australian and international postal schedules to specific locations it is unable to guarantee specific delivery dates for Products ordered through the Website and delivery later than these estimated times will not constitute a valid reason for returns or refunds for Products. In particular, normal time frames may be exceeded where remote locations are involved.
5.2 Risk and Title
Risk in the Products will pass to you upon despatch of the Products from aussiebest's premises in Australia. Notwithstanding the passing of risk, title in the Products delivered will not be passed to you until all amounts payable by you have been paid in full.
6. Customer Service
6.1 Returns, Exchanges and Refunds
At aussiebest, we are sure you will be delighted with your purchase of our Products, however, in the unlikely event that the Products you have purchased:
(a) contain a manufacturing fault;
(b) are not the same as described by aussiebest or as shown on the Website; or
(c) are not suitable for your intended use, if this use was notified to aussiebest prior to your purchase of the Products,
aussiebest will, at its cost, repair or replace the Products or refund your money, where the Products are returned by you to aussiebest, PO Box 293, Fremantle, Western Australia 6959, Australia , within thirty (30) days of delivery (‘ Warranty Period '). aussiebest will, however, exercise it discretion as to whether to issue a refund, complete repairs or provide replacement goods where the Products have been
(i) used other than in accordance with the instructions (if any) provided with the Products;
(ii) abused or damaged in any way by you; or
(iii) returned to aussiebest outside the Warranty Period (dependant on the circumstances).
In all other cases, including ‘change of mind' and wrong sizes, aussiebest will exercise its sole discretion as to whether to accept returns of the Products and issue refunds, exchanges or credits. You will bear the cost of the return of the unwanted Products to aussiebest in these circumstances and the freight costs of any exchanged or replacement goods issued to you.
Unfortunately, Products which have been custom made cannot be returned or exchanged unless the Products are faulty, not as described or shown on the Website or not suitable for a notified use.
6.2 Cancellation
You should contact aussiebest immediately should you wish to cancel any order for the Products placed through the Website. Requests for cancellation will be considered by aussiebest on a case-by-case basis and aussiebest will exercise its sole discretion in determining whether an order validly placed through the Website may be cancelled. aussiebest reserves the right to charge a 10% cancellation fee to cover administrative costs for any orders cancelled prior to the despatch of your order.
7. Limitation of Liability
You are solely responsible for your selection of Product and the use and application of Products purchased from the Website.
A number of the Products displayed on the Website may have medical, health or other practical applications. Such Products may be accompanied by written instructions as to appropriate and safe use (‘ Instructions ') and should be used in accordance with the Instructions at all times. Please note, however, that while the Instructions and the Website (including any testimonials) may indicate the recommended use or application of certain Products, they are not under any circumstances whatsoever intended as medical, health or other professional advice and should not be substituted for same. You should always obtain the appropriate advice for your particular circumstances from your doctor or health professional before using any of the Products.
Except in relation to the liability which cannot be excluded at law, in no event will aussiebest be liable or responsible to you for any loss or damage of any kind whatsoever (including but not limited to consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly out of your selection, use or application of the Products or the supply, delay or failure to supply the Products by aussiebest.
Where legislation implies into these Terms of Sale any condition or warranty which cannot be excluded at law, aussiebest's liability for breach of any such condition or warranty will be limited at aussiebest's sole discretion to the repair or replacement of the Products or the cost of having the Products repaired or replaced.

9. Governing Law
These Terms of Sale will be construed in accordance with and governed by the laws of the State of Western Australia and each party agrees to submit to the non-exclusive jurisdiction of the courts of Western Australia. If you choose to access and use the Website from other locations you do so of your own initiative and are solely responsible for your compliance with applicable local laws and regulations.
